Malaysia Enforces New Immunity Law to Enhance Diplomatic Relations

Kuala Lumpur, The Gulf Observer: Malaysian PM Anwar Ibrahim announced that the enforcement of the Jurisdictional Immunities of Foreign States Act 2024, effective from August 30 last year, aims to promote and strengthen diplomatic relations between Malaysia and other countries.

In a Facebook post, the Prime Minister highlighted that the Act reflects the principles of public international law concerning state immunity. He emphasized that this legislation is crucial for maintaining Malaysia’s competitiveness on the international stage, boosting the economy, and safeguarding national security. Additionally, it serves to enhance investor confidence in Malaysia’s legal framework by providing clear protections.

The Act signifies Malaysia’s formal adoption of customary international law, establishing that a state is protected from legal actions and proceedings in foreign courts. This move is part of broader institutional reform efforts to align Malaysia with international legal standards.

Earlier, the Prime Minister chaired the first Foreign State Immunity Council Meeting for 2025, following the enactment of the Jurisdictional Immunities of Foreign States Act 2024 (Act 853). The meeting aimed to provide an overview of the council’s functions, powers, and membership, while also discussing the process of applying for immunity under Act 853.

The implementation of this Act underscores Malaysia’s commitment to fostering robust diplomatic ties and creating a stable environment for international investment.
